He was promoted to captain on December 13, 1861. He was captured at the Battle of Cedar Mountain (August 9, 1862) and sent to Libby Prison. He was released in a prisoner exchange and returned to duty on November 15, 1862. On January 22, 1863, he was promoted to lieutenant colonel. On April 5, 1864, he was made a colonel of the 5th Regiment Massachusetts Colored Volunteer Cavalry.
