By 1884, Moore was dissatisfied with his arrangement with Durand, seeking to leave the company. In response, Durand offered a gentlemen's agreement wherein the firm's surveying and engineering work would be entirely handled by Moore. The men ultimately disagreed over the specific terms of the agreement, and in 1888 Moore left Durand and Company and sued his former employer.
